I concur in the result. 1 think the appointment should have been sent in for confirmation, but I am of opinion that the office should have been surrendered to Dr. O’Hara from the beginning, and that he, and not Dr. Dowling, is entitled to be put in possession of and remain in the office as the hold-over incumbent.
